Terms of Service

MACSBIT eKYC lets a business send identity-verification links to its customers over WhatsApp, process the identity document and selfie they submit using AI, review the results in a dashboard, and manage WhatsApp conversations. MACSBIT SOLUTIONS (Company No. 202003277735 (NS0242924-K)) operates it.

The service is actively maintained and continually enhanced. We may deploy updates, optimizations, and feature improvements from time to time.

• The service is for businesses and their authorised staff. You confirm you have authority to bind the business that registers.
• You must keep your login credentials confidential and are responsible for activity under your account and for the staff you invite.
• You must give accurate registration information and keep it up to date.

You are the party that decides to collect identity data from your customers. You are responsible for:

• having a lawful basis for collecting that data and for telling your customers why it is collected, how it is used and who it is shared with (including the sharing described in our Privacy Policy);
• obtaining any consent required by law before asking a person to submit identity documents or biometric images;
• complying with the WhatsApp Business Terms of Service and Meta's Business Messaging Policy, including sending messages only to people who have opted in or contacted you;
• meeting your own organizational requirements, such as customer due diligence, identity record keeping, and internal compliance policies. The service helps collect and read identity documents; it does not perform these duties for you;
• reviewing verification results and making your own decisions. Do not rely on a result alone where an error could cause serious harm.

You must not:

• use the service for unlawful, deceptive, harassing or spam messaging, or to collect identity data without a lawful basis;
• verify or process the identity of someone you have no legitimate reason to verify;
• attempt to break, probe, overload or reverse-engineer the service, or access data belonging to another business;
• resell or share access outside your business without our written agreement.

• Paid plans are billed in Malaysian Ringgit for a 30-day period through our payment processor. The plan, price and included usage are shown when you subscribe.
• When a subscription expires or is inactive, verification and messaging features are suspended until it is renewed.
• Usage limits (for example verifications and messages per period) apply as shown for your plan.
• Refunds, if any, are as stated at checkout or required by law.

The service depends on providers such as Meta (WhatsApp Business Cloud API), specialized AI and verification engines, our payment processor and cloud hosting infrastructure. Their availability, changes to their terms or pricing, or actions they take (for example restricting a WhatsApp number) are outside our control, and we are not responsible for them.

For the identity and conversation data of your customers, you are the data user and we are your data processor. We process it only to provide the service, as described in our Privacy Policy. You can ask us to delete data using the data deletion page.

We work to keep the service running, but we do not guarantee uninterrupted or error-free operation and we do not currently offer a formal uptime commitment. We may carry out maintenance that temporarily affects availability. Support is provided by email at billing@macsbit.com.

You may stop using the service and close your account at any time. We may suspend or end access if you breach these terms, if required by law or by Meta, or if your use creates a security or legal risk. On closure we will delete your account data as described in the Privacy Policy.

• The service is provided “as is” and “as available”. To the extent permitted by law we exclude all warranties, express or implied, including accuracy of AI results and fitness for a particular purpose.
• To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or goodwill, or for decisions you make based on verification results.
• Our total liability arising from the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
• Nothing in these terms limits liability that cannot be limited under Malaysian law.

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute.

We may update these terms. We will change the date above and notify account holders of material changes by email or in the dashboard. Continuing to use the service after a change means you accept it.
